General rental terms and conditions under the 2015 law

  1. Reservation
    You can make a reservation by phone or via the internet.  Reservation is binding on you and Mar y Sol Villas.  The rental period is incurred for a minimum of 1 week. Mar y Sol Villas confirm each booking order using a reservation confirmation. Upon receipt of the confirmation, you will pay 30% of the rent within 7 days. The booking is only final after we have received your deposit of 30% according to contract. The balance of the rent must be paid to our account no later than 8 weeks before the start of the rental period. For a short term booking, you must pay the entire rental fee. We can cancel (annul) the reservation if payment is not timely. Upon check-in, you must show proof of reservation to our on-site staff at the time of booking, with the reservation form and valid identification.
  2. Modification of terms and conditions
    Mar y Sol Villas reserves the right to change these terms and conditions at any time without notice, and you agree that your use of this site is subject to the terms and conditions in force at the time.
  3. Cancellation
    Cancellation is possible within 8 days, counted from the reservation date.  If cancelled after 8 days and up to 8 weeks before the start of the rental period, 30% of the rent will be charged. If cancelled 8 to 4 weeks before the start of the rental period, 60% of the rent will be charged. Cancellation can be by e-mail or letter. The cancellation fee is € 25.00.
  4. Cancellation by Mar y Sol Villas
    Cancellation by Mar y Sol Villas, if Mar y Sol Villas by force majeure cancel your reserved holiday accommodation, we will offer you an alternative of a similar type and price. If Mar y Sol Villas can not provide a similar rental accommodation, we will refund your already paid rent without compensation for any additional costs incurred. The tenant has no right other than the recovery of this amount.
  5. Liability
    Mar y Sol Villas only mediates between owner and tenant and therefore can not be held liable by the tenant for accidents/injury/damage that occurred during the rental period. Mar y Sol Villas reserves the right to refuse guests or cancel bookings if this is the case. In any case, Mar y Sol Villas is no longer liable than the rent paid by the tenant. Mar y Sol Villas can never be held liable for damages and/or costs incurred by the tenant. Mar y Sol Villas is not liable for non-culpable errors in the description on the website or published on ad portals on the internet.
  6. Damage
    During your stay in the holiday home, you and/or your travelling companions are fully liable for the rented holiday home as a tenant. Damage caused to the landlord must be met on the site. Mar y Sol Villas can accept no responsibility for loss, theft, damage or injury directly or indirectly caused by yourself. Mar y Sol Villas can accept no responsibility for damage resulting from natural violence, natural disasters, terrorist attacks, strikes.
  7. Security deposit
    In advance, you are required to pay a security deposit, which will be returned to your bank/giro account within 10 business days of departure (last rental day). Should any damage or break be detected after your stay, this will be settled with the deposit. The amount of the deposit is stated in your booking confirmation. You must also be able to identify yourself using a passport or ID card upon arrival.
  8. Young people
    The usual deposit is increased by € 100, – per person for younger groups. Also, a mandatory final cleaning fee applies. The deposit will be refunded to your bank or giro account within 10 business days of departure and inspection of the property.
  9. Age Restriction
    Different accommodations are not available for young people or groups. If upon check-in (arrival) it appears that there is a group of persons with an average age of less than 25 years, access will be denied without the possibility of any refund.
  10. Insurance
    We recommend that you get a good travel insurance and/or cancellation insurance.
  11. Tenant
    Between 22:00 and 07:00 we kindly ask you to make no noise/music with respect to night’s sleep of nearby residents. In the case of confirmed nuisance caused by the tenant, Mar y Sol Villas has the right to terminate the rental agreement immediately without any refund of paid rent or deposit.
  12. Upon leaving (check-out) of the accommodation, the tenant will provide
    Deposit household waste in the central waste containers.
    To clean the dishes, cutlery and kitchen utensils and at the designated place.
    Empty the dishwasher and leave it clean
    Take away bed sheets.
    Provide clean and empty Barbeque/fireplace
    Garden and terrace free from garbage (cigarette filters)
    Garden furniture on the spot like this on the first rental day has been taken into use.
    Additional cleaning fee may be charged if the house is not clean, and approved by the homeowner and/or inspector of Mar y Sol Villas.
  13. Tenant Responsibility
    The tenant is responsible for the proper treatment of the rented property/apartment and is liable for any damages caused by the tenant or fellow travellers during his/her stay.
  14. Pets
    Pets are not allowed everywhere you can find this in the property description on our website.
  15. Bed sheets
    Bed sheets can be hired if this is not offered at the holiday home. Please indicate when booking if you wish. Hand towels (Bathing towels and dish towels) should be brought by you unless stated otherwise. It is not allowed to sleep on the beds without the use of good sheets.
  16. Opening Hours
    Outside the high season, it may be that on certain days or hours the information listed on our site may be closed, for example, swimming pools, restaurants and shops. Mar y Sol Villas is not responsible for any facilities that were not accessible for any reason during your holiday.
  17. Arrival and Departure
    The house/apartment can be taken on the first day of rent between 16:00 and 20:00. Arrival later than 20:00, exclusively on request (costs €50,00). The house/apartment must be vacated before 10:00 on departure day. On departure later than 10:00, additional charges will be charged!
  18. Number of persons
    The number of persons mentioned in the house description is the maximum allowed number. Staying with more people than indicated when booking is not allowed. The placing of a tent, caravan or camper is not permitted. If the rental agreement is overridden, the lease agreement is deemed to be dissolved as a result and the access to the holiday home is refused without the right to claim a refund of the travel fee.
  19. Nuisance
    It may be that during your stay, work is ongoing on the road or the surrounding area. We understand that this can be a nasty situation for you. Mar y Sol Villas can not be held liable here; we have no influence on the occurrence that there may be no water or electricity during your stay. Mar y Sol Villas can not be held liable for this.
  20. Complaints
    Should you have a complaint on arrival or during your stay, please contact our employees immediately with the opportunity to resolve your complaint. The tenant must make a complaint on arrival at the holiday home or to report to our staff at the latest within 24 hours. Mar y Sol Villas will attempt to resolve the complaint immediately on the spot. You should at all times have the opportunity to provide Mar y Sol Villas with the opportunity to provide a suitable solution for the complaint during your stay. Early departure or the independent involvement of another property, release Mar y Sol Villas of any obligation to compensation.
  21. General Rental Terms 2015
    When you complete your booking, you accept that you have read and understood the terms and conditions and agree with the content.
